These Terms and Conditions apply to your use of the websites operated by Quarrying & Machinery Imports NZ Limited, Taupo Scoria Limited and Seay Earthmovers Limited. They also apply to goods purchased from QM Imports or Taupo Scoria Limited.

By using one of our websites, submitting an enquiry or placing an order for goods, you agree to these terms.

Earthmoving, contracting and other onsite services provided by Seay Earthmovers Limited are subject to the terms contained in the applicable quotation or separate written agreement.

“We”, “our” and “us” refer to the applicable business. “You” and “your” refer to the customer or website user.

1. The applicable business

Each business operates separately. The business named on your quote, order confirmation or invoice is the supplier responsible for that transaction.
No other business listed in these terms is a party to the transaction unless confirmed in writing.

2. Website information

We take reasonable care to keep our website information accurate and current. However, product details, specifications, availability and service information may change.

Images and descriptions are provided as a guide. Please confirm any information that is important to your purchase or project before proceeding.

3. Quotes and orders

Quotes are based on the information available when they are prepared and remain valid for the period stated.

An order or project is confirmed once accepted by us in writing. Changes to the scope, quantities, site requirements or customer instructions may affect pricing and timeframes.

If these terms conflict with an accepted quote or separate written agreement, the accepted quote or agreement will apply.

4. Products and compatibility

Customers must provide accurate machinery details, measurements, part numbers, photographs and intended use where required.

We may assist with identifying suitable products, but recommendations rely on the information provided by the customer. Products must not be installed or used if their suitability is uncertain.

Wear-part life will vary depending on installation, operating conditions, machinery, material and use.

Aggregate is a natural product and may vary in colour, texture and appearance.

5. Services and site requirements

The scope of any earthmoving, transport or related services will be confirmed in the applicable quote or agreement.

Customers must provide safe and suitable site access, disclose known hazards and underground services, and obtain any required permissions unless otherwise agreed.

Timeframes are estimates unless expressly confirmed in writing and may be affected by weather, site conditions, availability and circumstances outside our control.

6. Pricing and payment

Prices are in New Zealand dollars and exclude GST unless stated otherwise.
Payment is due in accordance with the terms shown on the applicable quote or invoice.

Additional work, products, freight or costs arising from changed instructions, quantities or site conditions may be charged separately.

We may delay or suspend supply where an account is overdue.

7. Delivery and collection

Delivery and collection arrangements will be confirmed when an order is accepted.
Delivery timeframes are estimates unless expressly guaranteed. We are not responsible for delays caused by transport providers, weather or circumstances outside our reasonable control.

Customers must provide safe access for delivery and suitable people or equipment for unloading where required.

8. Returns, faults and order issues

Please inspect products promptly and contact us if an item is damaged, faulty or different from what was ordered.

Products should not be installed or used where an issue has been identified.
Change-of-mind returns are not guaranteed and must be approved in advance. Approved products must generally be unused and in a resalable condition. Freight or restocking costs may apply.

Nothing in this section limits any rights that cannot legally be excluded.

9. Customer responsibilities

You are responsible for:

  • Providing complete and accurate information.
  • Checking that products and services are suitable before use.
  • Following installation, operating and safety requirements.
  • Ensuring work areas and delivery locations are safe and accessible.
  • Paying invoices by the applicable due date.

We are not responsible for loss caused by incorrect or incomplete information supplied by you.

10. Liability and consumer rights

We will supply goods and services with reasonable care and skill.
To the extent permitted by law, we are not responsible for loss or damage caused by incorrect installation or use, normal wear, inaccurate customer information, undisclosed site conditions, independent third parties or circumstances outside our reasonable control.

Where both parties are in trade and the goods or services are supplied and acquired in trade, the parties agree that the Consumer Guarantees Act 1993 will not apply to the extent that it is fair, reasonable and permitted by law.

Nothing in these terms excludes any rights or remedies that cannot legally be excluded under New Zealand law.

11. Intellectual property and third-party links

The content on our websites, including text, photography, graphics, branding and design, is owned by or licensed to us.

You may use website content for personal reference but may not reproduce or use it commercially without permission.

Our websites may contain links to third-party websites. We are not responsible for their content, security, availability or privacy practices.

12. Privacy

Personal information will be handled in accordance with our Privacy Policy and the Privacy Act 2020.

13. Changes to these terms

We may update these Terms and Conditions from time to time. The current version will be available on our websites.

Changes will not alter the terms of an order or project already accepted unless agreed in writing.

14. Governing law

These terms are governed by New Zealand law. Any dispute will be subject to the jurisdiction of the New Zealand courts.
